Legal advisory services during purchase of several apartment buildings

HMP advised a real estate company on the successful acquisition of a "building right" with several apartment buildings (around CHF 25 mil.). Our services included reviewing and negotiating of the purchase agreement, clarifying Lex Friedrich issues and answering various complex legal questions in connection with the "building right".

Legal representation and advisory services regarding acquisition of real estate portfolio
HMP assisted a listed real estate investor in the acquisition of a real estate portfolio consisting of 9 buildings in several cantons (around CHF 100 mil.). Despite a tight schedule and several notaries and land registries involved, the transaction was successfully executed by signing and closing in one day.

Markus Aeschbacher represented HMP/Switzerland at the Multilaw EMEA regional meeting in Malta, Valetta from 7 – 10 June 2018. 60 delegates from 35 law firms attended the conference with the main topic “block chaine”.

An important part of the Multilaw EMEA regional conference 2018 were once again the practice group meetings. Markus Aeschbacher, Partner at HMP, joined the strong litigation practice group.

Property company restructuring successfully completed

After some four years of work, we have today completed the conversion of a limited partnership in the property sector into a real estate stock corporation. The new company has assets of over CHF 50 million, consisting mostly of apartment buildings. It is family owned, and the conversion will provide a simpler and more secure basis for being passed to future generations.

Our real estate team also played a major part in settling a number of legal disputes that required resolution before the company could complete a CHF 35 million construction project.

Swissair case: Federal Supreme Court appeal re D&O liability action
In consultation with the creditors’ committee, HMP filed a timely appeal with the Civil Chamber of the Federal Supreme Court against the widely publicised Zurich Commercial Court decision of 16 March 2018 (HG130073) in Swissair’s D&O liability claim against fourteen former Swissair directors and officers and petitioned the Court to order all fourteen defendants to pay significant damages.
